The Prohibition on the Purchase of Residential Property by Non-Canadians Act landed January 1, 2023, banning most foreign nationals and foreign-controlled corporations from buying residential property in Canada for two years. That ban was extended to January 1, 2027 in Budget 2023. As of April 2025, we're 21 months into enforcement with enough case law, CRA guidance updates, and provincial carve-outs that your listing conversations need sharper language than "foreigners can't buy." Here's what the ban actually prohibits, who gets exempted, how provinces are handling it differently, and what you tell clients when a foreign buyer inquiry lands in your inbox.

The federal ban applies to residential property defined as buildings with fewer than four dwelling units, plus the land they sit on. Single-family homes, duplexes, triplexes: covered. Purpose-built rental buildings with four or more units: exempt. Recreational properties zoned for cottages or cabins that aren't in census metropolitan areas or census agglomerations with populations over 100,000: also exempt. The CRA publishes the list of affected CMAs and CAs annually; as of 2025, that's 41 metropolitan areas including Greater Toronto, Metro Vancouver, Calgary, Edmonton, Ottawa-Gatineau, and Montreal. If your listing is a lakefront cabin two hours north of Barrie in a township with 8,000 people, foreign buyers can still purchase it. If it's a condo-titled cabin in Whistler or Canmore, the ban applies.

Who Can Still Buy

Permanent residents are exempt outright. Temporary residents—work permit holders and international students—can buy one property if they meet conditions: work permit holders need a valid permit and filed Canadian tax returns for three of the four preceding years; international students need to have filed tax returns for five consecutive years and hold a valid study permit. Both groups can only purchase properties under $500,000. That threshold hasn't moved since the Act took effect, so in markets where median detached prices sit at $800,000 or $1.2 million, the exemption is functionally useless for most inventory. In Calgary or Winnipeg, where sub-$500,000 detached homes still exist in volume, it matters.

Foreign nationals married to or in common-law relationships with Canadian citizens or permanent residents are exempt with no price cap. The relationship must be genuine—CRA has flagged paper marriages in audit sweeps—and the property must be for spousal occupancy, not investment. Refugees under the Immigration and Refugee Protection Act are also exempt, as are diplomats and consular staff accredited by Global Affairs Canada.

Corporate Structures and the 3% Loophole

The ban targets foreign-controlled corporations, defined as entities where more than 3% of shares or votes are held by non-Canadians, or where non-Canadians hold shares carrying more than 3% of fair market value. This isn't a 50% control test—it's a 3% bright line. A numbered Ontario company with two Canadian shareholders holding 97% and one U.S. shareholder holding 3.1% cannot buy residential property under the ban. Trusts are treated similarly: if a non-Canadian is a beneficiary with more than 3% interest, the trust is caught.

Developers and institutional buyers use exemptions for purpose-built rental projects. If a foreign-controlled corporation is purchasing land or buildings for a project with four or more residential units intended for long-term rental, the ban doesn't apply. The CRA requires a statutory declaration at closing confirming the rental purpose. Flipping that project into condos later triggers penalties retroactively if the units are sold within the restriction period, which remains January 1, 2027 unless extended again.

Penalties and Enforcement

Violators face a $10,000 fine and potential forced sale. The forced sale provision allows the Crown to apply to the Federal Court to order divestiture, with proceeds going to the Crown after satisfying any registered mortgages. As of March 2025, CRA has issued 14 penalty assessments and initiated three forced sale proceedings, all in the Greater Toronto and Metro Vancouver areas. Lawyers are on the hook too: the Law Society of Ontario issued a practice advisory in June 2024 reminding solicitors that closing a transaction in violation of the Act exposes them to professional liability and potential LSO discipline.

Provincial Variations and Overlapping Restrictions

British Columbia's speculation and vacancy tax and foreign buyers tax remain in force alongside the federal ban. The BC foreign buyers tax is 20% of the purchase price on residential property in designated taxable regions, collected at closing. A foreign national exempt from the federal ban—say, a work permit holder buying a $450,000 townhouse in Surrey—still pays the 20% provincial tax unless they qualify for a separate BC exemption, which mirrors the federal work permit criteria but adds a requirement that the buyer intends to occupy the property as principal residence within 60 days.

Ontario's Non-Resident Speculation Tax is 25% on residential property in the Greater Golden Horseshoe, but it includes a rebate for foreign nationals who become permanent residents within four years or who are full-time students or work permit holders meeting similar criteria to the federal exemptions. The rebate application process is separate and must be filed within 90 days of closing. Alberta has no provincial foreign buyer restriction, so the federal ban is the only layer.

What You Say in Listing Conversations

When a foreign buyer inquires, your first question is status: citizen, permanent resident, work permit, study permit, or none of the above. If work permit or study permit, ask how many years of Canadian tax returns they've filed and confirm their price ceiling is under $500,000. If they're outside Canada and have no status, the conversation ends unless the property is recreational and outside a CMA/CA, or it's part of a four-plus-unit rental project they're buying as a corporation. If they're married to a Canadian, confirm the relationship is documented and the property will be occupied by the couple.

For corporate buyers, get a legal opinion on the shareholder structure before you invest time. If the corporation is foreign-controlled and the property is single-family or a duplex, it's a non-starter unless it's being converted into a rental building with four or more units and they're prepared to file the statutory declaration. For developers, confirm the project qualifies and that their counsel has reviewed the CRA's guidance on rental purpose.

Your listing agreement should include a warranty from the seller that they're aware of the ban and that any offer from a prohibited person will be rejected. Your buyer representation agreement should include a similar acknowledgment from the buyer that they've disclosed their status accurately and understand that misrepresentation can void the transaction and trigger penalties. If you're working with a foreign buyer who qualifies for an exemption, get their status documentation—work permit, tax filings, permanent resident card—before you show property. Lenders will require it anyway, and you don't want to discover a gap after an offer is accepted.

The ban expires January 1, 2027 unless extended a second time. Budget 2026 will signal intent, likely in March or April 2026. Until then, treat every foreign buyer inquiry as a documentation exercise first, a transaction second. Confirm status, verify exemptions, involve legal counsel early, and don't assume that because someone has a work permit or is married to a Canadian that they automatically qualify—price caps, tax filing history, and occupancy intent all matter. The CRA is auditing these transactions retroactively, and the penalties land on buyers, sellers, and their agents if due diligence wasn't done.
