Typical Canadian pre-construction contracts require 15-20% in staggered payments over 12 to 24 months. However, this can be negotiated to help buyers with cash flow limitations if developers are looking to accelerate sales.

Real estate professionals who can negotiate alternative deposit terms, such as smaller upfront payments, longer timelines or back-loaded structures, can make a project more accessible to a broader pool of clients. Developers often allow assignments only after a certain percentage of the building is sold, and may charge fees or require price floors. These limitations can significantly impact investment timelines.

Professionals advising investor clients should confirm whether assignment rights are available, at what fee and under what conditions. Push for reduced assignment fees and eliminate minimum resale price clauses, if possible. Developers who see value in your repeat business may offer preferential treatment here.

Some newer agreements also contain restrictions on short-term rentals, corporate ownership or leasing caps, which can affect long-term returns. Be aware of any restrictions, and guide your client on whether the project remains viable under those terms.

Closing Costs and Transparency

Final closing costs are often underestimated in pre-construction transactions. These may include:

Land transfer tax (provincial and municipal, where applicable)
Development levies
Utility hook-up fees
Legal disbursements
Tarion warranty enrollment
Occupancy fees (where applicable)

Ensure clients are budgeting correctly and request developers to cap any ambiguous or open-ended charges. Instruct clients to get these caps written into the APS.
